Limited Warranty

This warranty does not affect your legal rights in accordance with the laws and provisions of your country or region. The terms specified in this warranty should be executed to the extent permitted by the laws of your country or region. When the warranty period of this policy is not sufficient to cover the scope of the law in your country or region, your local policy regulations shall prevail.

This warranty does not apply to

• Products or parts whose warranty has expired.
• Products purchased through unauthorized channels, or products resold by other buyers.
• Normal discoloration, wear and tear, and consumption that occur during use.
• Failure or damage caused by incorrect or improper use, maintenance, or storage — including improper handling, use outside the product’s intended purpose, improper plugging/unplugging of external devices, drops or improper impact, exposure to improper temperatures, solvents, acids, alkalis, water intrusion, insect or rodent infestation, or intrusion of foreign objects.
• Failure or damage caused by installation, repair, alteration, addition, or removal by any unauthorized agency or person.
• Damage caused by unauthorized modification, disassembly, or removal of the casing, or failure to follow the official manual or instructions.
• Products or parts whose original identification information has been modified, altered, or removed.
• Products or parts for which you can’t provide a valid receipt or other proof of warranty status. (Reach out to Swing Design for your invoice, if needed.)
• Failure or damage caused by illegally authorized, non-standard, or non-public software.
• Damage caused by reliability or compatibility issues from unauthorized third-party parts.
• Failure or damage caused by virus infection, hacking, or other malicious infringement.
• Failure or damage caused by force majeure or accidents.
• Damage that occurs during transit back for repair.
• Other failure or damage not caused by product quality.
• Products that are expected to operate uninterrupted or error-free.

Special notes

• Product packaging, complimentary items, consumables, and accessories aren’t covered by the warranty.
• No other promises made by xTool or third-party agents are guaranteed unless confirmed in writing.
• For products that will be or have been discontinued, an announcement will be issued with the final maintenance date after which warranty service ends.
• For products sold with separate after-sales service agreements, the confirmed contract terms take precedence.
• If you submit a valid claim under this Limited Warranty, at sole discretion the remedy may be: (1) instructions and new or refurbished parts to repair the product; or (2) authorization to return the product for repair, replacement with an equivalent new or refurbished product, or a refund of the purchase price.

Scope of responsibility

During after-sales service, loss of the product is covered only while responsibility for transit and repair has been assumed. Unless otherwise required by law, there is no liability for personal injury or any incidental, special, indirect, or consequential damages — including but not limited to loss of profits, loss of data, business interruption, or other commercial damages or losses — arising out of or related to use or inability to use the product, however caused, regardless of the theory of liability, even if advised of the possibility of such damages.

Relationship of consumer law to this policy

This warranty gives you specific legal rights, and you may have other rights that vary by state, province, or country. Except as permitted by law, this warranty does not exclude, limit, or suspend other rights you may have, including those arising from noncompliance with a sales contract. To fully understand your rights, consult the laws of your state, province, or country. To the extent permitted by law, this warranty and its remedies are exclusive and in lieu of all other warranties, remedies, and conditions, whether oral, written, statutory, express, or implied — including warranties of merchantability, fitness for a particular purpose, and warranties against hidden or delayed defects. Some states, provinces, and countries do not allow limitations on the duration of implied warranties, so the above limitations may not apply to you.
